LOCATED IN A CONSERVATION AREA?

If you are a business owner (or representative) with properties located within a conservation area or that contain trees protected by a tree preservation order (TPO), specific regulations and obligations must be followed before any tree-related activities can be undertaken. In most situations, obtaining approval from your respective local council is a prerequisite prior to the commencement of any work. There can be legal consequences if this process isn’t adhered to. If you need assistance in preparing and submitting the necessary application, we can provide that help for a nominal extra charge. Once the approval is granted, we can carry out the required work. Note that any local council can prosecute should work be carried out in a TPO-area without due authorisation. Fines can range between £2,500 to £20,000.

BIRDS NESTING IN THE TREE?

During the nesting season, which spans from February to August, there’s a legal obligation to take precautions and refrain from disturbing nesting birds. This mandate encompasses not only the trees, hedges, and bushes on the property but also neighbouring vegetation, as the shade provided by a tree might serve as protection for birds against predators and the weather. To ensure compliance, it's essential to conduct a thorough pre-works survey. While there are exceptions based on health and safety concerns, acquiring a licence from DEFRA is necessary in most cases. This comprehensive approach covers all wild birds, including pigeons, magpies, and crows. If the work cannot be carried out during this period, we would defer it until the nesting season is over.
